Terms and Conditions

These Terms and Conditions govern the relationship between Nanny Poppins Ltd., a company registered in England and Wales under company number 15020615 whose registered office is at 3 Newell Road, Stansted, England, CM24 8UT ("we", "us", "our"), and any individual or entity ("Client", "you", "your") engaging our services to source and/or employ childcare professionals ("Nannies").

By using our services, you agree to be bound by these Terms and Conditions.

 

1. Definitions

Agency: Nanny Poppins Ltd.

Client: Any individual or organisation requesting the Agency to introduce a nanny or childcare professional.

Candidate/Nanny: A person introduced by the Agency to the Client for potential or actual engagement.

Engagement: The employment or use of a Candidate on a temporary, permanent, full-time, or part-time basis.

 

2. Services Provided

Nanny Poppins provides recruitment and placement services for nannies and other childcare professionals, including:

Permanent placements

Temporary and emergency cover

Live-in and live-out arrangements

Part-time and full-time roles

 

3. Client Responsibilities

The Client agrees to:

Provide accurate job details, including salary, hours, duties, and accommodation (if applicable).

Interview and assess the Candidate before confirming employment.

Provide a legally compliant contract of employment to the Candidate.

Comply with all UK employment laws, including tax, National Insurance, pension contributions, and working time regulations.

Treat the Candidate fairly, respectfully, and within a safe working environment.

 

4. Agency Fees

Permanent Placements

A placement fee equal to 3x of the Candidate’s gross annual salary is payable upon written acceptance of an offer by the Candidate.

Temporary Placements

A daily or weekly fee will be agreed upon in writing prior to engagement.

All fees are payable within 7 days of invoice.

Late payments may incur interest in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.

 

5. Refunds and Replacements

If a Candidate leaves within the first four weeks of employment, we will provide a free replacement, subject to availability, or offer a partial refund on a sliding scale:

Week 1: 80% refund

Week 2: 60% refund

Week 3: 40% refund

Week 4: 20% refund

After Week 4: No refund

Refunds are not applicable where:

The Client cancels the engagement.

The Candidate leaves due to unreasonable conditions, late or non-payment, or a breach of contract.

The Client fails to inform the Agency of the termination within 3 working days.

 

6. Candidate Screening

We conduct reasonable checks on Candidates, including:

Interviews

ID verification

Right to work in the UK

DBS check (if available)

Reference checks (minimum two)

However, we cannot guarantee the accuracy or completeness of information provided by Candidates.

 

7. Confidentiality

Both parties agree to treat all information regarding Candidates and Clients as confidential and not disclose it to any third party without prior written consent, except as required by law.

 

8. Liability

The Agency is not liable for any loss, damage, or injury arising from the actions or omissions of any Candidate.

The Client is responsible for verifying the Candidate’s suitability, has a full and final driving license with the appropriate insurance and must ensure the Candidate has the legal right to work in the UK.

Nanny Poppins Ltd. accepts no liability for any injury, loss, or death resulting from the actions or omissions of a nanny introduced by the agency, as the nanny is employed directly by the client and operates under their sole supervision and responsibility.

 

9. Termination

The Agency reserves the right to withdraw Candidates or terminate services at any time without notice if:

The Client breaches these Terms

There is evidence of illegal or unsafe employment practices

The working conditions provided are unsuitable or hazardous

 

10. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising shall be subject to the exclusive jurisdiction of the English courts.

 

11. Amendments

We reserve the right to amend these Terms and Conditions at any time. Updated versions will be posted on our website and will take effect upon publication.
